Here at Berk Law Group, we always strive to stay informed about updates and changes in the Arizona probate, trust and estate world. Here are the key updates and reminders from the recent Bench Bar Meeting:
Court Forms
- Pre-Signed Order & Acknowledgement
The pre-signed (Judge Fink) Order and Acknowledgement is available on the Court Forms page. - Updated Forms
Several court forms have been updated, including guardianship and accounting forms. Please ensure you are using the latest versions.
Accelerated Rulings – ARCP 19 and 15(i)
- Include the accelerated ruling request in the caption.
- Explain why an accelerated hearing is needed.
- A Motion for Accelerated Hearing is still required.
- Best Practice:
- File your petition and obtain a hearing date.
- Then file a separate motion for an expedited hearing (do not include this request in your petition; the clerk will not see it).
- If possible, obtain opposing counsel’s approval.
- Tip: Read the rules carefully to avoid delays.
PLAP (Probate Lawyers Assistance Program)
- Support Needed: PLAP continues to assist 500+ individuals annually.
- Free Consultations: Attorneys work in shifts each Wednesday to provide six half-hour consultations on various probate, guardianship and/or conservatorship issues.
- Volunteer Opportunities:
- You’ll receive an email with the volunteer calendar.
- No pressure—volunteer when you can.
- Contact: Kelly Kral at 602-254-6008 for questions or to get involved.
E-Filing for Probate
- A live demonstration walked through the e-filing process and how to obtain a conformed copy after filing.
- Key Points:
- Each filing attorney must have their own login.
- Judicial officers receive e-filings within 24 hours.
- No need to email proposed orders to the JA if lodged, unless the hearing is imminent.
- Do not email JAs with filings—they have electronic access unless it’s last-minute.
- Confidential Filings: Must be clearly titled as confidential (further guidance coming soon).
- Training: https://urldefense.com/v3/__https:/outlook.office365.com/book/[email protected]/__;!!KLEl7LSNBzLtGRk!Y-wcK4lG1Y4EWbTmXJWbwWxUBNl-VVujNYqoUoc-pOAV7Xd6WGdU3WDAhBE1P31LWaThK7OFE9UgVPQzFQJMeDEic45tzbNz$
- Looking Ahead: E-filing will become mandatory for attorneys in the future.
Final Reminders
- Always check the latest court forms before filing.
- Follow ARCP rules for accelerated hearings.
- Take advantage of PLAP volunteer opportunities.
