- My Background
I approach every case with tenacity, thoroughness, and a willingness to fight when it matters. My goal is simple: to treat my clients the way I would want to be treated if I were in their position. That means not only understanding the law, but also thinking through the real-world impact of every decision. Legal, financial, and emotional.
I work closely with each client, giving personal attention to their situation and striving to resolve matters as efficiently and cost-effectively as possible. When the situation calls for it, I don’t hesitate to go the extra distance.
I became a lawyer in large part because I’ve always believed in standing up to bullies. In many of the disputes I handle, particularly in probate, trust, and estate litigation, there is often a power imbalance. Someone is being taken advantage of, ignored, or pushed aside. I see my role as leveling that playing field and making sure my clients have a strong, strategic advocate in their corner.
I was born in Denver, Colorado, and moved to Scottsdale, Arizona in 1972. I graduated from Arizona State University with a degree in business and finance in 1988, and then earned my law degree magna cum laude from Tulane Law School in 1992, where I was inducted into the Order of the Coif. After law school, I served as a judicial clerk to the Honorable Sherman G. Finesilver, Chief Judge of the United States District Court for the District of Colorado.
In addition to my work with clients, I am committed to contributing to the legal community through speaking, teaching, and writing. I regularly present on probate, trust, and estate litigation topics, as well as the evolving role of technology and AI in legal practice. I enjoy breaking down complex issues into practical, usable insights for attorneys and legal professionals. I also publish articles and educational content aimed at helping both colleagues and the public better understand the legal landscape.
If you would like to learn more or discuss your situation, I welcome you to reach out.
I focus my practice on probate, trust, and estate litigation. We represents individuals and families in disputes that are often complex, high-stakes, and emotionally charged.
My work includes:
- Probate, estate, will, and trust disputes: Including will contests, trust contests, fiduciary disputes, and claims involving undue influence, lack of capacity, and breach of fiduciary duty.
- Elder abuse, neglect, and financial exploitation: Representing victims and families in cases involving misuse of authority, coercion, or improper control over vulnerable individuals and their assets.
- Guardianships and conservatorships: Including contested appointments, disputes over control, and issues involving the management of personal and financial affairs.
In many of these matters, there is a clear imbalance of power. I represent clients who need someone in their corner. Someone who can step in, take control of the situation, and advocate effectively on their behalf.
In addition to my legal practice, I am an active writer and presenter. I have taught seminars and given presentations on probate litigation, financial exploitation, artificial intelligence in legal practice, and real estate-related disputes for organizations including the Arizona Department of Economic Security, the State Bar of Arizona, and the Maricopa County Bar Association.
In 2023, I was honored to receive the Robert R. Mills Member of the Year Award from the Maricopa County Bar Association. This award recognizes a member who has gone above and beyond in contributing to the association, furthering the ideals of the legal profession, and dedicating themselves to public service.
In 2026, I was elected to and currently serve on the Board of Governors of the Maricopa County Bar Association.
After completing my judicial clerkship, I joined O’Connor Cavanagh, then the second-largest law firm in Arizona, where I handled a wide range of disputes, litigation matters, and arbitrations from 1993 to 1996. That experience gave me a strong foundation in complex litigation and high-level legal strategy.
In 1996, I founded Berk Law Group, PC, driven by a desire to build a practice focused on client service, strategic advocacy, and independence. Over the years, I have represented clients in virtually every type of dispute, lawsuit, and arbitration, giving me broad experience that I now bring to my focused practice in probate and trust litigation.
Outside of my legal practice, I have been involved in a number of business and community ventures. I am a co-founder of Pure Pickleball, LLC, and a co-founder and former owner of AZ on the Rocks – Indoor Climbing, Inc. I have also served as a Director of the Arizona Mortgage Lenders Association and as President and Director of the Council for Jews With Special Needs, now known as Gesher Disability Resources.
Earlier in my career, I coached high school baseball and Little League, which remains one of the most rewarding experiences I’ve had outside the practice of law.
When I’m not working, I enjoy spending time with my family, playing pickleball, rock climbing, hiking, working with clay, reading, and traveling.
I am licensed to practice law in Arizona and am a member of the American, Arizona, and Maricopa County Bar Associations.
