Common probate/estate disputes include will or trust contests based on lack of testamantary capacity, undue influence, fraud, financial exploitation, forgery and other issues. Financial Exploitation: The financial exploitation of vulnerable adults occurs with shocking frequency—with strangers, friends, and even family helping themselves to the money and property of the vulnerable adult. Our firm protects vulnerable adults and helps their loved ones hold the person who committed the wrong responsible. Our firm also defends those who have been wrongly accused of exploitation.
Abuse/Neglect: The abuse or neglect of a vulnerable adult is a serious problem, requiring the involvement of an experienced attorney. At our firm, we thoroughly investigate these claims, helping the vulnerable adult’s loved ones bring the abuser to justice. We also defend those wrongly accused of elder abuse and neglect.
Guardianship/Conservatorship: A guardian (to handle health and welfare decisions) or conservator (to handle assets and finances) may be appointed in Arizona for an adult who is incapacitated. When a dispute arises over the appointment of a guardian or conservator or the management of a guardianship or conservatorship, we may be able to help. We work to assure that a guardianship or conservatorship is imposed only when it is truly necessary and proper under Arizona law. We can assist in seeking the appointment of a guardian or conservator for an adult who cannot handle his or her own affairs.
